Your data, handled plainly.

The short version: we only collect what we need to reply to you, do our work and keep our accounts. We never sell your data, and you can ask us to see, correct or delete it at any time by emailing hello@thatotheragency.co.uk.

Who we are

That Other Agency Ltd is a company registered in England and Wales, company number 16799053, based in London. We are the data controller for the personal data described here, which means we decide how it is used and we are responsible for looking after it.

What we collect

  • When you send an enquiry. Your name, email address and anything you choose to tell us in the form, such as your company or website, your monthly media spend, the tools you use and your message.
  • When you arrive from one of our ads. On our dashboard enquiry page, we also note how you found us: the campaign tags in the link you clicked (UTM tags and any Google or Meta click ID), the page you landed on and the site you came from. These are sent with your enquiry, so we can see which ads work.
  • When you browse the site. Google Analytics records which pages are viewed, roughly where visitors are (country and city), the device and browser used, and how people arrived. Google Analytics does not store your IP address.
  • When the site is loaded. Our hosting provider keeps short technical logs, including IP addresses, to keep the site secure and working.
  • When you email us or become a client. Your messages, contact details and business details, plus the invoices, payments and contracts that go with our work together.

We do not collect special category data, such as health information, and we do not make decisions about you by automated means.

Why we use it

  • To reply to your enquiry and talk about working together. This is in our legitimate interests, and it is a step you have asked us to take before any contract.
  • To do the work you hire us for, and to send invoices and take payment. This is needed to carry out our contract with you.
  • To keep our accounts and tax records, which the law requires us to do.
  • To understand how the site is used and which ads bring enquiries, so we can improve both. This is in our legitimate interests. See the cookies section below.

We will not add you to a mailing list or send you marketing unless you ask us to.

Who we share it with

We never sell your data. We use a small number of trusted services to run the business, and they only handle your data on our instructions:

  • FormSubmit, which passes enquiries from our website forms to our inbox.
  • Google, for our email (Google Workspace) and website analytics (Google Analytics).
  • Vercel, which hosts this website.
  • FreeAgent, Mettle and GoCardless, for invoicing, banking and payments if you become a client.

We may also share data with our professional advisers, or where the law requires it, for example with HMRC.

Data outside the UK

Some of these services store data outside the UK, for example in the United States or the European Union. Where they do, the transfer is protected by the safeguards UK law requires, such as the UK Extension to the EU US Data Privacy Framework or the UK International Data Transfer Agreement.

How long we keep it

  • Enquiries that do not lead to work: up to two years, then deleted.
  • Client records, invoices and contracts: six years after the end of the financial year they relate to, as UK tax and company law requires.
  • Google Analytics data: 14 months at most.
  • Hosting logs: a short time, usually days, for security.

Cookies

We use Google Analytics, which sets two cookies, _ga and _ga_RZKD9WTJYR, to tell visits apart. They last up to two years. We do not use advertising cookies.

On our dashboard enquiry page, your browser also keeps the campaign details described above for that visit only (in session storage, not a cookie), and forgets them when you close the tab.

We are adding a cookie banner so you can choose whether to allow analytics. Until it is live, you can block these cookies in your browser settings, or with Google's opt out add on. The site works the same without them.

When we work for a client

When we build a dashboard, run campaigns or work on a store for a client, we may handle data that belongs to that client, such as their customers' orders. In that work we act for the client as a data processor, under our agreement with them, and the client's own privacy notice applies to that data.

Your rights

You can ask us to:

  • give you a copy of the data we hold about you
  • correct anything that is wrong or incomplete
  • delete your data, where we no longer need to keep it
  • stop or limit how we use it, or object to us using it
  • send your data to you or another organisation in a common format
  • withdraw any consent you have given

Complaints

If you are unhappy with how we have handled your data, please tell us first and we will try to put it right. You can also complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.

Changes to this notice

We will update this page if anything changes, and the date at the top will show when it last changed.
